Buildradar Terms of Service

By using the Buildradar web sites (“Service”), a service of “Brightapps BV”, you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

This Service is strictly intended for business-to-business (B2B) use. By registering, you warrant that you are acting as a legal entity or professional.

Brightapps BV reserves the right to update and change the Terms of Service. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. Violation of any of the terms below may result in the suspension or termination of your Account, at our sole discretion. While Brightapps BV prohibits such conduct and Content on the Service, you understand and agree that Brightapps BV cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. To the fullest extent permitted by applicable law, you agree to use the Service at your own risk.

These Terms are governed by Belgian law. Any disputes arising from or related to these Terms shall be exclusively submitted to the competent courts of East Flanders, Ghent division.

Account Terms

Accounts must be registered by authorized representatives of the legal entity; automated registration by "bots" or other unauthorized methods is strictly prohibited.
You must provide your legal full name, a valid email address, and any other information requested during the signup process.
Each login may only be used by one person; sharing a single login between multiple individuals is strictly prohibited. You may create separate, individual logins for authorized users.
You are solely responsible for maintaining the security of your account and password. Brightapps BV shall not be liable for any loss or damage arising from your failure to comply with this security obligation.
You are fully responsible for all Content posted and all activity occurring under your account, including activity by any individuals authorized to access your account.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the course of using the Service, violate any applicable laws in your jurisdiction, including but not limited to intellectual property and copyright laws.


Account and user/password sharing

One person or legal entity may not maintain more than one free or paying account.
One user belongs to one physical person, and it is not allowed to share passwords between users. In the event that Brightapps BV determines, in its sole discretion, that an account has been shared in violation of these terms, you agree to pay any applicable fees or lost revenue that would have been due had each user purchased a separate account.


API Terms

Customers may access their Buildradar account data via an API. Any use of the API, including usage through third-party products, is bound by these Terms of Service plus the following specific conditions:

Liability: You expressly acknowledge that Brightapps BV shall not be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, loss of profits, data, or business interruption) resulting from your use of the API or any third-party products that access data via the API.

Usage Limits: Abuse or excessively frequent requests via the API may result in the temporary or permanent suspension of API access. Brightapps BV, in its sole discretion, determines what constitutes abuse or excessive usage. We will make a reasonable effort to notify the account owner via email prior to suspension.

Service Modifications: Brightapps BV reserves the right to modify or discontinue API access at any time. For Enterprise or Pro clients, we will provide at least 3 months’ advance notice for material changes to the API. For all other clients, such changes may be made with or without prior notice.

Responsibility for Integrations: You are solely responsible for all activity conducted through your API credentials. Any third-party product you use to access the API is your responsibility, and Brightapps BV assumes no liability for the security or data practices of such third-party services.

Server Uptime / Maintenance Windows

Brightapps BV guarantees 99% uptime of our Buildradar servers over a rolling 12-month window. Excluded from our uptime guarantee are outages resulting from:
- Scheduled downtime with prior email notifications to our customers.
- Customer acts, omissions, or misuse of the services, including violations of the Terms of Service
- Failures of your internet connectivity.
- Factors outside our reasonable control, including internet access-related problems, force majeure events, and third-party services or technology failures.
- Your equipment, services, or other technology.

If our yearly uptime percentage drops below our 99% guarantee, Pro or Enterprise accounts are entitled to receive Service Credits. These credits will be calculated as a pro-rata discount on the subsequent annual subscription renewal, based on the duration of the downtime exceeding the guarantee. The total liability for such downtime in the form of Service Credits is strictly limited to a maximum of 15% of the annual subscription fee paid by the customer per year.

Service Credits are not granted automatically and must be requested by the client in writing to support@buildradar.be within 30 days of the incident. Other types of accounts are not entitled to downtime compensation.

Payment, Refunds, Upgrading and Downgrading Terms

1. Free Trial
New users are entitled to a 14-day free trial to evaluate the Service. No payment details are required to initiate the trial.

2. Subscription Model and Billing
Subscription Model and Billing: Subscriptions are billed annually in advance. Payment is due within 14 days of the invoice date. Access to the Service is contingent upon timely payment. Brightapps BV reserves the right to suspend access to the Service for any account with outstanding, overdue invoices.

3. Cancellations
Cancellations: You are responsible for actively canceling your account if you do not intend to renew. To terminate, you must email support@buildradar.be at least 15 days prior to the annual renewal date. Failure to do so will result in a renewal invoice for which you remain liable.

4. Upgrading and Downgrading
- Upgrading: You may increase your plan or add users at any time. You will be issued a supplementary invoice for the pro-rated cost for the remainder of the subscription year.
- Downgrading: You may not downgrade your plan or reduce user count during an active annual period. Changes will take effect at the start of the next renewal, provided notice is sent to support@buildradar.be at least 15 days before renewal.

5. Refunds and Taxes
Refunds and Taxes: All payments are non-refundable. No refunds or credits will be issued for partial usage or unused time, regardless of when the cancellation occurs. All fees are exclusive of applicable taxes, which are the responsibility of the customer.

Cancellation and Termination

Account Cancellation: You are solely responsible for properly canceling your account. Cancellations must be requested via email to support@buildradar.be; requests made via other channels are not valid.

Effect of Cancellation: Upon termination, all of your content will be permanently deleted from the Service and cannot be recovered. If you cancel before the end of your annual term, you will retain access until the end of the paid period, and no refunds or pro-rated credits will be issued.

Termination by Brightapps BV: Brightapps BV reserves the right to suspend or terminate your account at its sole discretion.
For Cause: In the event of a violation of these terms or illegal activity, we reserve the right to terminate your access immediately, without notice.
For Convenience: For Busineses or Enterprise clients, we will provide at least 3 months’ notice prior to termination for convenience. For all other clients, we reserve the right to terminate with or without notice.

Consequences of Termination: Any termination will result in the deactivation of your account and the forfeiture of all stored content. Brightapps BV reserves the right to refuse service to anyone at any time, subject to the notice periods defined above.

Modifications to the Service and Prices

Service Changes: Brightapps BV reserves the right to modify or discontinue the Service (or any part thereof) at any time. For Business or Enterprise clients, we will provide at least 3 months’ prior notice for material changes or discontinuation. For all other clients, such changes may be made with or without prior notice.

Price Adjustments: Prices for all Services are subject to change upon 30 days’ notice. Such notice may be provided by posting the changes on the Buildradar website or via email.

Custom Licenses: If you have an agreement for a custom license price, your annual fee is subject to an automatic 3% yearly indexation.

Limitation of Liability: To the fullest extent permitted by applicable law, Brightapps BV shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Copyright and Content Ownership

User Content: All content posted on the Service must comply with applicable Belgian copyright law. We claim no intellectual property rights over the material you provide to the Service; your profile and uploaded materials remain yours. By uploading content, you grant Brightapps BV a non-exclusive, worldwide, royalty-free license to host, store, and display such content solely to provide the Service to you.

Content Monitoring: Brightapps BV does not pre-screen content, but we reserve the right (but not the obligation), in our sole discretion, to refuse or remove any content available via the Service that we determine to be in violation of these Terms of Service or applicable law.

Service Intellectual Property: The "look and feel" of the Service, including all design elements, is the copyright of Brightapps BV. All rights reserved by Brightapps BV. You may not duplicate, copy, reuse, or reverse-engineer any portion of the HTML/CSS, visual design elements, source code, database structure, or proprietary algorithms without express written permission from Brightapps BV. Furthermore, you agree not to create any derivative works based on the Service, nor to use our intellectual property to develop a competing product or service.

General Conditions

Service Basis: Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. Brightapps BV provides no warranties, express or implied, regarding the accuracy, reliability, or suitability of the Service for your specific requirements.

Technical Support: Support is provided to paying account holders via email (support@buildradar.be) or in-app chat, on a “best effort” basis. Enterprise clients may negotiate a formal Support SLA for an additional fee.

Prohibited Conduct: You must not:

  • Modify, adapt, hack, or reverse-engineer the Service.
  • Reproduce, sell, or exploit any portion of the Service without our written permission.
  • Upload "spam," viruses, worms, or any code of a destructive nature.
  • Abuse or threaten any Brightapps BV officer, employee, or customer; such actions will result in immediate termination.

Content Moderation: We reserve the right, at our sole discretion, to remove content or accounts that are unlawful, offensive, defamatory, or in violation of these Terms.

Bandwidth Usage: If your bandwidth usage significantly exceeds the average bandwidth usage of other Buildradar customers, we reserve the right to throttle your access or disable your account until usage is reduced.

Fair Use Policy: Although certain plans may offer features on an unlimited basis, your usage must remain reasonable and fair. "Fair use" is defined as usage that does not disrupt the performance, security, stability, or availability of the Service for other users. If your usage (including but not limited to automated requests, data generation, or platform activity) significantly exceeds the normal patterns of an average professional user, Brightapps BV reserves the right to temporarily throttle, limit, or suspend your access until a reasonable usage level is restored.

Limitation of Liability: To the fullest extent permitted by law, Brightapps BV shall not be liable for any direct, indirect, incidental, or consequential damages—including loss of profits or data—arising from the use or inability to use the Service, unauthorized access to your transmissions, or any other matter relating to the Service.

Entire Agreement: These Terms constitute the entire agreement between you and Brightapps BV, superseding any prior agreements. The failure of Brightapps BV to enforce any right shall not constitute a waiver of such right.

Privacy & GDPR Policy


Brightapps BV (Buildradar) is committed to protecting the personal data of our B2B users. This Privacy Policy explains how we collect, use, and safeguard personal data in accordance with the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) and applicable Belgian privacy laws.

1. Types of Personal Data We Collect

We may collect and process the following personal data provided voluntarily by you during registration, trial, or support requests:

  • Name, first name, and job title
  • Company name, business address, and invoicing details
  • Email address and telephone number
  • Login credentials (passwords are strictly stored encrypted)
  • IP address, browser type, and usage data regarding your interactions with the Buildradar platform and website (collected via cookies necessary for session management).

2. Legal Grounds and Use of Data

We process personal data on the following legal grounds: the performance of our contract with you (providing the Service, billing, and support), compliance with legal obligations, or our legitimate business interests (improving our platform and sending relevant product updates, from which you can opt-out at any time).

3. Data Storage and Third-Party Processors

While Brightapps BV owns the code, databases, and all rights to the Buildradar application, you retain all rights to your uploaded data. We utilize trusted third-party vendors and hosting partners (such as Amazon Web Services (AWS) for cloud infrastructure and PCI-compliant processors like Braintree/PayPal for credit card billing) to run our services.

All personal data is hosted within data centers located in the European Union (EU). Any future cross-border data transfers outside the EEA will be secured via Standard Contractual Clauses (SCCs) approved by the European Commission.

4. Security and Backups

We implement appropriate physical, technological, and organizational precautions to prevent unauthorized access, loss, or alteration of your data. This includes strict password complexity requirements and automated, encrypted database backups performed every 24 hours (retained for 30 days).

In the event of a data breach affecting your personal information, we will notify you via email without undue delay, outlining the impact and our corrective actions.

5. Your Privacy Rights

Under the GDPR, you have the right to access, rectify, restrict, transfer, or request the deletion of your personal data at any time. Please note that deleting required data may result in the termination of your access to the Service. You can exercise these rights by contacting support@buildradar.be.

6. Custom DPA (Data Processing Agreement)

Given our automated delivery model, the data processing rules stipulated in these Terms shall govern the Service. If a custom DPA is strictly required by your organization, please contact us. Note that custom DPAs are only available for subscriptions with 50 licenses or more, and terms will not materially deviate from this standard policy.

7. Policy Updates

Brightapps BV may periodically update this policy. We will notify you of significant changes by sending a notice to the primary email address specified in your account.
